Yoler Marketing (www.rinkodara.eu) provides you with access to the website https://www.rinkodara.eu (the "Site") and invites you to purchase the services offered here.
Definitions and key terms
To help clarify things as clearly as possible, whenever the following terms are mentioned, they are strictly defined as:
Cookie: a small amount of data generated by a website and/or application and stored by your web browser. It is used to identify your browser, to perform analytics, to remember information about you, such as the language you choose or your login information.
Company: when this Policy refers to "Company", "we", "us" or "our", it means RB PREMIERE CAPITAL HOLDING SIA (Matīsa iela 61A-20, Riga, LV-1009, Latvia), which is responsible for your information in accordance with the Eulogy.
Country: the country in which the owners and/or founders of Yoler Rinkodara (www.rinkodara.eu) or Yoler Rinkodara (www.rinkodara.eu) are located, in this case Latvia.
Service: means the service provided by Yoler Rinkodara (www.rinkodara.eu) as described in the relative terms (if any) and on this platform.
Third Party Services means advertisers, competition sponsors, advertising and marketing partners and others who provide our content or whose products or services we think may be of interest to you.
Website: the Yoler Marketing website, which can be accessed at the following URL: https://www.rinkodara.eu.
You: the person or organization that has registered with Yoler Marketing (www.rinkodara.eu) to use the Services.

Introduction
This End User License Agreement ("Agreement") is a binding agreement between you ("End User," "you," "you," or "your") and RB PREMIERE CAPITAL HOLDING SIA ("Company," "we," "us," or "our"). This Agreement governs the relationship between you and us and your use of the Company's Yoler Marketing (www.rinkodara.eu). For purposes of this Agreement, the End User and the Company may be referred to as a "Party" or collectively as the "Parties".
If you are using the Site on behalf of your employer or another entity ("Organization") for whom you are using the Site or who owns or otherwise controls the means by which you use or access the Site, then the terms "End User," "you," "your," and "yours" collectively apply to you as an individual and the Organization. If you use the Site or purchase a license or access the Site on behalf of the Organization, you represent, warrant and covenant that you have the right to (1) purchase a license to use the Site on behalf of the Organization; and (2) bind the Organization to the terms of this Agreement.
By downloading, installing, accessing or using the Website, you: (a) certify that you have all necessary permissions and authorizations to use the Site; (b) if you are using the Site under a license purchased by the Organization, you certify that you are authorized by the Organization to use the Site; (c) certify that you have read and understood this Agreement; (d) certify that you are of sound mind and of legal age (at least 18 years of age) to enter into a binding contract; and (e) agree and consent to be legally bound by the terms and conditions of this Agreement.
If you do not agree to these terms, please do not download, install, download, access or use the Software. If you have already downloaded the Software, please delete it from your computer device.
Yoler Marketing (www.rinkodara.eu) licenses, not sells, the Software to you for use strictly in accordance with the terms of this Agreement.
License
Subject to the terms of this Agreement and, if applicable, the terms of the License Agreement, Yoler Marketing (www.rinkodara.eu) grants you a limited, non-exclusive, perpetual, revocable, and non-transferable license:
(a) download, install and use the Software on one (1) Computing Device under the single user license that you have purchased and been granted. If you have multiple Computing Devices on which you intend to use the Software, you agree to purchase a license for the number of Computing Devices you intend to use;
(b) access, view and use on such Computing Device the End User Submissions contained in or otherwise made available through the Software in strict accordance with this Agreement and all other terms and conditions applicable to such End User Submissions;
(c) install and use a trial version of the Software on any number of Computing Devices for a period of fifteen (15) unique days after installation.
(d) receive upgrades and new features that become available within one (1) year from the date of purchase of the Software license.
Restrictions
You agree not to do and will not allow others to do so:
License, sell, rent, lease, assign, distribute, transfer, host, order, disclose or otherwise commercially exploit the Software or make the Software available to any third party.
modify, create derivative works from, disassemble, decompile, decipher, compile or reverse engineer any part of the Software.
Remove, alter or obscure any proprietary notice (including any copyright or trademark notice) of Yoler Marketing (www.rinkodara.eu) or its affiliates, partners, suppliers or licensors of the Application.
Intellectual Property
All intellectual property rights, including copyrights, patents, disclosed patents and inventions (whether or not patentable), trademarks, service marks, trade secrets, know-how and other confidential information, trade dress, trade names, logos, company names and domain names, together with all related goodwill, derivative works and all other rights (collectively, the "Intellectual Property Rights") that are part of the Software and that otherwise belong to Yoler Marketing (www. rinkodara.eu), shall at all times remain the exclusive property of Yoler Marketing (www.rinkodara.eu) (or its suppliers or licensors, if and when applicable). Nothing in this Agreement grants you (or any other Organization) a license to Yoler Marketing (www.rinkodara.eu)'s intellectual property rights.
You agree that this Agreement grants you a limited license to use the Yoler Marketing (www.rinkodara.eu) Intellectual Property Rights only as part of (and not separate from) the Software and only during the term of the license granted to you under this Agreement. Accordingly, your use of any Yoler Marketing (www.rinkodara.eu) intellectual property rights independently of the Software or outside of this Agreement will be deemed an infringement of Yoler Marketing (www.rinkodara.eu) intellectual property rights. However, this does not limit any claim by Yoler Marketing (www.rinkodara.eu) for breach of contract if you breach any term or condition of this Agreement. You shall use the highest standard of care to protect all Software (including all copies thereof) from infringement, misappropriation, theft, misuse or unauthorized access. Except as expressly provided in this Agreement, Yoler Marketing (www.rinkodara.eu) reserves and retains all right, title, and interest in and to the Software, including all copyrights and copyrightable subject matter, trademarks and trademarkable subject matter, patents and patentable subject matter, trade secrets, and all other intellectual property rights, whether registered, unregistered, granted, asserted, or otherwise, now existing or that may hereafter be created, in and to it.
You (or the Organization, if and as applicable) own all intellectual property rights in the work products that you create using the Software or using the Software.
Your suggestions
Any feedback, comments, ideas, improvements or suggestions ("Suggestions") that you provide to Yoler Marketing (www.rinkodara.eu) in connection with the Application shall remain the sole and exclusive property of Yoler Marketing (www.rinkodara.eu).
Yoler Marketing (www.rinkodara.eu) is free to use, copy, modify, publish or distribute the Offers for any purpose and in any manner, without providing you with any information and without payment of any compensation.
Changes to the Application Form
Yoler Marketing (www.rinkodara.eu) reserves the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it is connected, with or without notice and without incurring any liability.
Updates to the Application
Yoler Marketing (www.rinkodara.eu) may, from time to time, provide enhancements to the features and/or functionality of the Application, which may include bug fixes, bug corrections, updates, enhancements, and other changes (collectively, "Updates").
Updates may modify or remove certain features and/or functions of the Software. You agree that Yoler Marketing (www.rinkodara.eu) is under no obligation to (i) provide any Updates or (ii) continue to provide or enable certain features and/or functionality of the Application.
You further agree that all Updates (i) will be considered an integral part of the Application and (ii) will be subject to the terms of this Agreement.
Term and Termination
This Agreement shall remain in full force and effect until terminated by you or Yoler Marketing (www.rinkodara.eu).
Yoler Marketing (www.rinkodara.eu) may, in its sole discretion, suspend or terminate this Agreement at any time and for any or no reason, with or without notice.
This Agreement will terminate immediately, without notice to Yoler Marketing (www.rinkodara.eu), if you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Software and all copies thereof from your computer.
Upon termination of this Agreement, you must cease all use of the Software and delete all copies of the Software from your computer.
Termination of this Agreement shall not limit any of Yoler Marketing (www.rinkodara.eu)'s rights or remedies at law or in equity if you (during the term of this Agreement) breach any of your obligations under this Agreement.
Indemnity
You agree to indemnify, defend and hold Yoler Marketing (www.marketing. eu) and its officers, directors, employees, agents, affiliates, successors and assigns from and against any loss, damage, liability, deficiency, claim, demand, judgment, settlement, interest, award, award, penalty, cost, or expense of any kind whatsoever, including reasonable attorneys' fees, arising out of or related to: (i) your use or misuse of the Software; (ii) your failure to comply with any applicable law, regulation, or governmental request; (iii) your violation of this Agreement; or (iv) your agreement or relationship with the Organization (if applicable) or any third party. You further agree that Yoler Marketing (www.rinkodara.eu) has no responsibility or liability whatsoever for any information or content that you provide or make available through the Software or that is provided to you by third parties.
No warranties
The Software is provided to you on an "As Is" and "As Available" basis, with all faults and defects, without warranty of any kind. To the fullest extent permissible pursuant to applicable law, Yoler Marketing (www.rinkodara.eu) expressly disclaims, on behalf of itself and its affiliates and their respective licensors and service providers, all warranties of any kind, whether express, implied, statutory, or otherwise, with respect to the Application, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties that may arise from trade, course of dealing, course of performance, use, or usage of trade practices. Without limiting the foregoing, Yoler Marketing (www.rinkodara.eu) makes no warranties and makes no representations or representations that the Application will meet your requirements, will achieve the intended results, will be compatible with or work with other software, applications, systems or services, will be uninterrupted or error-free, will meet any performance or reliability standards, or that any error or defect can or will be corrected.
Without limiting the foregoing, neither Yoler Marketing (www.rinkodara.eu) nor any Yoler Marketing (www.marketing. eu) service provider makes any representations or warranties, express or implied, (i) as to the operation or availability of the Application, or the information, content, materials, or products contained therein; (ii) that the Application will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or timeliness of any information or content provided through the Application; or (iv) that the Application, or the Application's servers, content, or e-mails sent from Yoler Marketing (www. rinkodara.eu) or on its behalf are free of viruses, scripts, Trojan horses, worms, malware, time bombs or other harmful components.
Some jurisdictions do not allow the exclusion or limitation of implied warranties or limitations thereof, nor do they allow the limitation of applicable statutory user rights, so some or all of the above exclusions and limitations may not apply to you.
Limitation of Liability
Notwithstanding any potential damages, the entire liability of Yoler Marketing (www.rinkodara.eu) and any of its suppliers under any provision of this Agreement, and your sole remedy for all of the foregoing, shall be limited to the amount actually paid by you for the Program.
To the fullest extent permitted by applicable law, Yoler Marketing (www.marketing. eu) or its suppliers shall in no event be liable for any special, incidental, indirect or consequential damages (including, without limitation, damages for loss of profits, loss of data or other information, business interruption, personal injury, loss of privacy, arising out of or in any way related to the use of or inability to use the Application, third party software and/or third party hardware used in connection with the Application, or otherwise related to any provision of this Agreement), even if Yoler Marketing (www. rinkodara.eu) or any supplier has been advised of the possibility of such damages and even if the remedy is not in accordance with its essential purpose.
Some states/jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Exclusivity
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be modified and interpreted to achieve the purposes of such provision to the extent possible under applicable law, and the remaining provisions will remain in full force and effect.
Waiver of the Obligation
The failure or delay of either party to exercise any right or power under this Agreement shall not constitute a waiver of that right or power. Nor shall any single or partial exercise of any right or power under this Agreement preclude the continued exercise of that or any other right conferred by this Agreement. In the event of any conflict between this Agreement and any applicable purchase or other terms and conditions, the terms of this Agreement shall govern.
Amendments to this Agreement
Yoler Marketing (www.rinkodara.eu) reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If the change is material, we will give you at least 30 days' notice before the new terms become effective. What constitutes a material change shall be determined at our discretion.
Once any change is effective, by continuing to use or access our App, you agree to be bound by the amended terms. If you do not agree to the new terms, you are no longer entitled to use the App.
Applicable Law
This Agreement and your use of the Application shall be governed by the laws of Latvia, excluding its conflict of laws provisions. Your use of the Application may also be subject to other local, state, national or international laws.
Changes to this Agreement
We reserve the exclusive right to amend this Agreement from time to time. Your continued access to and use of the Site constitutes your acceptance and agreement to the terms and conditions then posted. You acknowledge and agree that you accept this Agreement (and any modifications to it) each time you load, access or use the Site. We therefore encourage you to review this Agreement regularly.
If, within thirty (30) days of the posting of changes or additions to this Agreement, you decide that you do not agree to the updated terms, you may withdraw your acceptance of the revised terms by providing us with written notice of withdrawal. If you provide us with a written notice of revocation, you will no longer have the right to use or access the Site.
No employment or agency relationship
Nothing in this Agreement or any part of the relationship between you and Yoler Marketing (www.rinkodara.eu) is intended to create, and shall not be deemed or construed to create, any relationship between you and Yoler Marketing (www.rinkodara.eu) other than the relationship with the end user of the Site and the services provided.
Right Help
You acknowledge and agree that a breach of this Agreement would cause Yoler Rinkodara (www.rinkodara.eu) irreparable harm for which monetary damages alone would not be sufficient. In addition to damages and other remedies to which Yoler Marketing (www.rinkodara.eu) may be entitled, you acknowledge and agree that we may seek injunctive relief to prevent actual, threatened or continuing breach of this Agreement.
Captions
The headings in this Agreement are for guidance only and do not limit the scope of this Agreement or otherwise affect its interpretation.
Geographical limitations
The Company is located in Latvia and is intended for use by persons located in Latvia and is therefore subject to Latvian laws and regulations. If you use the Site from outside Latvia, you are solely responsible for compliance with local laws.
Time limit for making claims
Any action or claim that you may bring arising out of or relating to this Agreement or the Website must be commenced within one (1) year from the date the action or claim arose, otherwise such action or claim will be forever barred.
Entire Agreement
The Agreement constitutes the entire agreement between you and Yoler Marketing (www.rinkodara.eu) with respect to your use of the Application and supersedes all prior and contemporaneous agreements, whether written or oral, between you and Yoler Marketing (www.rinkodara.eu).
Your use or purchase of other Yoler Marketing (www.rinkodara.eu) services may be subject to additional terms and conditions that Yoler Marketing (www.rinkodara.eu) will provide to you at the time of such use or purchase.
